Motorcyclist Deaths on Nevada Highways – What Families Should Know
A single-vehicle motorcycle crash does not automatically mean the rider was solely responsible. Nevada highways can carry hidden hazards, and families have the right to ask questions before accepting any conclusion.
Could road conditions have been a factor? A motorcycle that travels right and leaves the roadway may have encountered a road defect, debris, an unmarked hazard, or a poorly maintained shoulder. If a road condition contributed to this crash, liability may extend to the agency responsible for maintaining that stretch of the 215 beltway. An independent investigation, separate from the NHP inquiry, can determine whether road conditions played a role.
What rights does the family have before the investigation concludes? Families do not need to wait for the official investigation to finish before consulting an attorney. An attorney can independently preserve evidence, request maintenance records for the road, and monitor the investigation as it progresses. Evidence from highway crashes – skid marks, road surface conditions, and debris disappear quickly.
What can a wrongful death claim cover in Nevada? Under Nevada’s wrongful death statute (NRS 41.085), surviving family members, including spouses, children, and dependents, may pursue compensation for funeral and burial expenses, loss of financial support, and loss of companionship. The specific circumstances of the crash determine what is available and who may be liable.
Nevada’s deadline: Wrongful death claims must be filed within two years of the date of death. Acting early protects the family’s legal options and ensures critical evidence is preserved before it is lost.
