What to Do and Who Pays After a Motorcycle Hits a Pedestrian in Las Vegas
Clark County carries most of Nevada’s pedestrian and motorcycle deaths. The Nevada Office of Traffic Safety counted 51 pedestrian deaths statewide from January through July 2026. Clark County accounted for 36 of them, along with 34 of the state’s 45 motorcyclist deaths in the same period.
Anyone hurt in a crash like this one can protect their health and their claim with six steps:
- Get a medical evaluation the same day, even without pain. Head injuries, internal bleeding, and fractures often surface hours later.
- Request the crash report number from LVMPD. Every insurer involved will ask for it.
- Keep the clothing, shoes, and any bag worn during the crash. Do not wash or discard them, since they can show impact points.
- Note nearby cameras, such as business entrances, bus shelters, and gas stations. Private systems often record over footage within days.
- Notify your own auto insurer, even though you were walking. Medical payments coverage on your policy can apply to pedestrian injuries.
- Keep every medical bill, prescription receipt, and missed-work record in one folder from day one.
Those steps preserve the evidence. Nevada law then decides who pays. Every driver, including a motorcyclist, must exercise due care to avoid hitting a pedestrian (NRS 484B.280). That duty applies whether or not the pedestrian is in a crosswalk.
Police have not released which party had the right of way, so fault in this crash remains open. An injured pedestrian usually claims first against the motorcyclist’s liability insurance. Nevada’s minimum bodily injury coverage is $25,000 per person (NRS 485.185).
A hospital stay can exceed that limit quickly. Underinsured motorist coverage on the pedestrian’s own auto policy may then cover the gap. That coverage pays when the at-fault rider’s policy is too small.
Four points decide a claim like this one:
- Who may be liable: the motorcyclist, and in some cases an owner who lent the motorcycle to an unsafe or unlicensed rider.
- What evidence decides it: the LVMPD findings, the signal phase at the moment of impact, where the pedestrian was crossing, and the motorcycle’s speed.
- How shared fault works: Nevada follows modified comparative negligence (NRS 41.141). An injured person recovers damages when their share of fault is 50% or less. The award drops by that percentage.
- The filing deadline: Nevada allows two years for a personal injury claim (NRS 11.190). For this crash on October 8, 2026, that deadline is October 8, 2028.
