What Are Your Legal Rights After a Fatal Pedestrian Accident in Nevada?

Losing a loved one in a pedestrian accident is devastating. Nevada law gives surviving family members the right to pursue a wrongful death claim, but the window to act is limited.

  • Who can file: Spouses, children, and parents of the deceased are typically eligible to file a wrongful death claim in Nevada
  • Statute of limitations: Nevada allows two years from the date of death to file, missing this deadline means losing your right to compensation permanently
  • Shared fault does not disqualify you: Even if your loved one was partially at fault, Nevada’s comparative negligence law may still allow you to recover compensation
  • What you can recover: Medical bills, funeral and burial costs, lost financial support, and loss of companionship
  • Evidence disappears fast: Surveillance footage, witness memories, and physical evidence degrade quickly, early legal action protects your case
