The fatal crash occurred around 9:30 p.m. on Rancho Drive between Gowan Road and Duncan Drive. The investigation found the man was crossing outside of a marked crosswalk when he was struck by a vehicle traveling southbound. The pedestrian was pronounced dead at the scene.
The driver remained present and cooperated with police; impairment is not suspected.
Our deepest condolences go out to the family and loved ones of the man who tragically lost his life on Rancho Drive.
Fatal Pedestrian Accident: The Battle Over Fault and Wrongful Death Rights
When a pedestrian is killed outside of a crosswalk, the surviving family has the right to file a Wrongful Death Claim. Still, their case faces an immediate challenge under Nevada’s Modified Comparative Negligence Law.
Insurance companies will seize the “outside of a crosswalk” detail to argue the pedestrian was primarily at fault. Under Nevada law (NRS 41.141), if the deceased is found to be 51% or more at fault, the family is barred from recovering any damages whatsoever. The legal battle hinges entirely on proving the driver bore substantial fault, perhaps due to:
Distracted Driving: Failing to maintain a proper lookout.
Excessive Speed: Even if not “speeding,” speed can be excessive for the conditions.
Failure to Exercise Caution: Every driver has a duty to look for pedestrians, regardless of where they are crossing.
Immediate legal intervention is required to secure evidence (like traffic camera footage and driver cell phone records) to shift the percentage of fault away from the victim and ensure the family receives compensation for funeral costs, loss of financial support, and pain and suffering.
