Clients always ask me, “Should we file a lawsuit?”, and this question always comes up in cases where there aren’t a lot of medical bills and the client was hurt but got over their injuries after a few short months. This is always a tough situation, because usually the scenario is simple: Client has X amount of medical bills, but the insurance company is only offering Y. Y does not cover X, but X is low enough where it may not be worth engaging in two to three years of litigation to fight with an insurance company.
This is a common game played by insurance companies. They send out low ball settlement offers on small cases betting on the odds that most people will not want to engage in a legal battle. My response is simple. If the settlement is not good enough, ALWAYS FILE THAT LAWSUIT. Insurance companies, with their billions of dollars have teams of adjusters and lawyers dedicated to fighting claims day in and day out. You may think would my one case make a difference? The answer is Yes. It will. If everyone fights for their rights than insurance companies will have to change their tactics and pay our FAIR AND REASONABLE settlements.
For this very reason, we will engage insurance companies in lawsuits big and small and in every court. On a rare occasion, we will even go to Small Claims Court to fight for your rights. In Nevada, small claims court have jurisdiction up to $10,000.00 in damages which makes the small cases a perfect fit. Big or small, insurance companies will never make it easy. This is why you need to fight for your rights.
